Introduction

Welcome to Circl! These Terms of Service (“Terms”) govern your use of Circl, operated by KODIGI SAS (“we,” “us,” “our”). By accessing or using Circl, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must not use Circl.

Company Legal Name and Description

Circl is operated by KODIGI SAS, a company registered in France. Circl provides a platform where content creators (“Creators”) can share exclusive content with subscribers (“Fans”) who pay for access through subscriptions, one-time purchases, or tips.

User Accounts

To access Circl, you must register and create an account. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. You must be at least 18 years old or the legal age of majority in your country to register.

Subscriptions and Payments

Circl offers several payment options: monthly subscriptions, one-time purchases, and tipping. Payments are processed securely through our third-party payment providers. By subscribing to or purchasing content, you agree to pay the specified fees for access to a Creator’s content.

Refund requests are reviewed and handled on a case-by-case basis by Circl. If you have a refund request or issue with a purchase, please contact us at support@circl.my. By completing a purchase, you acknowledge and agree to this policy.

Content Ownership and Licensing

Creators retain full ownership of the content they upload to Circl. By uploading content, Creators grant Circl a license to display their content to Fans who have paid the required fees. Fans receive a personal, non-transferable license to view the content for personal use only and may not reproduce or share it without the Creator’s permission.

Content Provider Requirements and Agreements

As a Creator on Circl, you must comply with the following requirements:

  • You must obtain and maintain written consent from all persons depicted in your content, specifically covering:
    • Consent to be depicted in the content
    • Consent for public distribution and upload of the content to Circl
    • Consent for content downloading where applicable
  • You must verify and maintain proof of identity and age for all persons depicted in your content, ensuring they are of legal age (18 or older)
  • You must be able to provide supporting documentation for age and identity verification upon request
  • You are prohibited from engaging in any illegal activities or activities that violate our Standards
  • All uploaded content will be reviewed before publication to ensure that it is not illegal and does not violate our Standards.

By creating a Creator account on Circl, you must explicitly agree to these terms by checking the "I agree to the Creator Terms and Conditions" checkbox during registration. This agreement constitutes a legally binding contract between you and KODIGI SAS.

Prohibited Conduct

You agree not to use Circl to engage in activities that violate any laws, infringe the rights of others, or are harmful to the platform. Violations may result in suspension or termination of your account, as detailed in our Acceptable Use Policy.

Complaint and Content Removal Procedure

Circl aims to maintain a safe and respectful platform. If you have a complaint or wish to report inappropriate content, please follow the procedure outlined in our Complaints Policy. Circl reserves the right to remove content or suspend accounts that violate our guidelines.

Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.

Limitation of Liability

Circl is provided on an "as is" and "as available" basis. We do not guarantee that Circl will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied. Circl is not liable for any damages arising from your use of the platform, including direct, indirect, incidental, or consequential damages.

Termination

We reserve the right to terminate or suspend your account at our discretion, without prior notice, if you violate these Terms or engage in prohibited activities. You may also delete your account at any time by accessing your account settings.

Changes to These Terms

Circl may modify these Terms at any time. Changes will be posted on this page, and your continued use of Circl following the posting of any changes constitutes acceptance of the revised Terms.
